Bush 41 Federal Judge Randa Protects Dolan’s Cemetery Scam Slush Fund with "Religious Liberty" Special Elitist Federal Bankruptcy Protection

Judge Rudolph Randa, the lame duck Republican judge for the Eastern Federal District of Wisconsin signed off on Archbishop’s Burial Insurance Perpetual Care Cemetery shell game Scam recently. 

I say lame duck as Judge Randa resigned his seat in 2008 on condition of it being filled only by a Bush 43 appointment before 2009. The appointment never happened, so Republican Hack Toady Federal Judge gives lives on in federal court to give a figurative free bl*wj*b to his fellow Republican friend and fellow Catholic Archbishop Timmy Dolan as well as a potential free get out of jail card protecting him from federal prosecution, helping him to continue to screw for a second time Milwaukee’s Catholic Clergy abuse and rape victims.

A federal judge in Wisconsin handed down an opinion yesterday granting the Catholic Church — and indeed, potentially all religious institutions — such sweeping immunity from federal bankruptcy law that it is not clear that it would permit any plaintiff to successfully sue any church in any court. While the ostensible issue in this case is whether over $50 million in church funds are shielded from a bankruptcy proceeding triggered largely by a flood of clerical sex abuse claims against the Archdiocese of Milwaukee, Judge Rudolph Randa reads the church’s constitutional and legal right to religious liberty so broadly as to render religious institutions immune from much of the law.

When he was Archbishop of Milwaukee, Timothy Dolan chose the dead people, placing $55 million into cemetery trust funds and out of the reach of local abuse victims suing the Church. (They want compensation for the suffering caused by childhood sexual trauma.) Dolan left Milwaukee to take the most visible post in Catholic America -- cardinal of New York City - but he could not escape his choice. The victims asked a federal bankruptcy judge to reverse him, and on Friday she did. For now the $55 million is available to settle hundreds of well-documented cases in which priests raped and sexually molested children and adolescents.  

Bankruptcy Judge Susan V. Kelley discussed her decision in court on Friday, explaining that neither First Amendment protections for religion nor federal law protect the archdiocese from her authority. She sided with creditors in the bankruptcy proceedings, who said the main purpose of the 2008 transfer was to place it out of their reach. In fact the archdiocese had managed the task of mowing the grass and otherwise maintaining cemeteries for generations without a $55 million trust generating income for that purpose.
